FDP representatives further argued that the tax results in unequal treatment, as approximately 90% of taxpayers have been exempted from it in recent years.

Despite these arguments, the judges concluded that the need for additional financing related to reunification persists, thereby justifying the continuation of the surcharge.

The solidarity surcharge is imposed at a rate of 5.5% on income, corporate taxes, and capital gains.

The court’s ruling highlighted that while the tax will continue to be collected, its legitimacy is dependent on an ongoing assessment of the necessity for such a financial measure.

The judges noted that if the underlying reasons for the tax were to cease, its continuation would become unconstitutional.

According to estimates, the solidarity tax is projected to generate approximately €12.6 billion (around $13.6 billion) annually for the federal budget.

Should the tax have been ruled unconstitutional, the government would face a substantial fiscal shortfall and the potential repayment of roughly €65 billion in revenues collected since 2020.

The court's decision has elicited varied responses from political factions.

Christian Dürr, the former FDP parliamentary leader, acknowledged the rejection of their complaint but characterized the ruling as a prompt for the government to pursue further tax relief measures.

In contrast, the Christian Democratic Union (CDU) has called for immediate tax reforms aimed at enhancing the competitive positioning of German businesses in the global marketplace.

Initially introduced in 1991 to assist in infrastructure development and economic transition in former East Germany, the solidarity tax was intended as a temporary measure but became a permanent feature of fiscal policy by 1995. Currently, the application of the tax mainly affects Germany's highest earners and businesses, given the significant decrease in the proportion of taxpayers subjected to it over recent years.

During the court proceedings, an expert analysis indicated that the financial obligations stemming from reunification are expected to continue to exert pressure on the federal budget until at least 2030.
