A 30-year-old man has been sentenced to six years in prison after being found guilty of manslaughter in connection with a fatal dispute over a parking space in Berlin.

The ruling by the Berlin Regional Court comes approximately seven months after the incident, which occurred on July 11, 2024, in the Gesundbrunnen district.

The victim, a 37-year-old man, was stabbed in the abdomen following a confrontation that erupted after he parked his newly acquired vehicle in a manner that blocked a parking space.

This action incited a dispute that involved multiple individuals, including the defendant's brother.

According to the court proceedings, the victim had stopped in the second lane of the roadway to show the vehicle to a friend when the altercation began.

The defendant, a passenger in his father's car, became involved as the disagreement escalated into physical violence.

During the trial, the defendant admitted to using a knife with an 11.9-centimeter blade to stab the victim.

The presiding judge, Thomas Groß, pointed out the regrettable inability of those involved to de-escalate the situation, describing it as a 'toxic mixture' of recklessness and an alarming disregard for personal safety, particularly among younger men equipped with knives.

Despite the violent nature of the act, Judge Groß stated that the absence of characteristics typical of premeditated murder warranted the charge of manslaughter rather than murder.

The defendant's legal representation argued that he acted in a moment of fear for his father's safety and amid panic.

His attorney described the incident as a mistake within a fraught situation that resulted in 'terrible consequences,' emphasizing that it did not reflect the defendant's character, who had no prior criminal record.

During the proceedings, the prosecution recommended a sentence of six years and eight months, while the defense sought a maximum sentence of five and a half years.

Ultimately, the court considered the defendant's lack of a previous criminal history and his prior compensation of €15,000 to the victim's family when determining the sentence.
