Indictment permits formal charges against Bolsonaro and seven co-conspirators following violent attempts to undermine democratic processes.
The Supreme Court of Brazil has approved an indictment against former President Jair Bolsonaro, allowing for formal charges to be brought against him and seven alleged co-conspirators.
This decision was reached unanimously by all five judges of the First Chamber in response to a request from the public prosecutor's office, which accuses Bolsonaro and his associates of plotting to overturn the electoral results after his defeat in October 2022. Bolsonaro served as Brazil's president from January 2019 until December 2022 and has denied all allegations against him.
The indictment comes in the wake of events on January 8, 2023, when a group of Bolsonaro supporters stormed the Brazilian Congress, presidential palace, and Supreme Court in Brasília in a violent protest against President Luiz Inácio Lula da Silva's victory.
This attack resulted in significant damage to government properties.
Judge Alexandre de Moraes remarked that the alleged criminal organization had undertaken the necessary steps to unseat the legally elected government but ultimately failed due to a lack of military support.
The actions of Bolsonaro and his supporters have drawn comparisons to the January 6, 2021, storming of the U.S. Capitol by supporters of then-President
Donald Trump.
Bolsonaro has been referred to as the 'Tropical Trump' in light of their similar political rhetoric and leadership styles.
Besides Bolsonaro, the indictment includes former public security chief Alexandre Ramagem, former justice minister Anderson Torres, and former defense minister Braga Netto.
These individuals are also accused of attempting to dismantle Brazil's democratic framework through violent means, as well as forming a criminal organization.
Like Bolsonaro, they have denied the charges against them.
With the Supreme Court trial now initiated, both the prosecution and defense will have the opportunity to present evidence and summon witnesses.
Following the presentation of evidence, the Court will determine the fate of the defendants.
A conviction could result in a sentence of up to twelve years in prison for the coup charges.
Decisions rendered by the Supreme Court are final and cannot be appealed.
Bolsonaro is currently barred from public office until 2030 and faces additional investigations.
These include allegations surrounding the illegal sale of jewelry and luxury watches he received as official gifts during his presidency while in Saudi Arabia.
Furthermore, investigators are looking into claims that he falsified
COVID-19 vaccination records for himself, family members, and staff.
Bolsonaro has consistently denied all these allegations.
