German Nationals Charged with Espionage for Alleged Military Technology Sale to China

Federal Prosecutor's charges against three individuals raise alarms on international technological espionage
Germany's Federal Prosecutor has charged three German nationals with espionage, accusing them of transferring sensitive military technology information to Chinese intelligence, a move that underscores growing global concerns over technological espionage.

On December 20, 2024, the charges were filed, drawing widespread attention to what represents a significant instance of alleged spying activities.

The individuals charged, identified as Herwig F., Ina F., and Thomas R., are suspected of collaborating with the Chinese Ministry of State Security (MSS) by providing them with crucial military technology data.

These individuals will now face the State Protection Senate at the Higher Regional Court in Düsseldorf, Germany, on these counts.

According to the prosecutor's office in Karlsruhe, Thomas R.

had been under investigation since 2017 on the suspicion of acting as an agent for a Chinese intelligence officer.

The trio, allegedly operating out of Düsseldorf, is accused of gathering and distributing intelligence on advanced military-relevant technologies, which included data on boat engines, sonar systems, aircraft defense systems, tank vehicle drives, and military-grade drones.

The prosecution contends that Herwig and Ina F., reportedly a couple, used a business enterprise in Düsseldorf as a front to facilitate their espionage activities.

This enterprise engaged with various businesses and research institutes from February 2017 until April 2024, during which substantial and sensitive information was allegedly transmitted to the MSS.

Particularly incriminating in the accusations is a cooperation agreement purportedly established by Herwig and Ina F.

with a German university, ostensibly for scientific research purposes.

During this collaboration, they reportedly crafted a study on the technological status of plain bearings—a key component in ship engine applications—for a Chinese client allegedly connected to the MSS.

The funding for this project was said to derive from Chinese state sources.

Furthermore, the defendants face allegations of procuring and illegally exporting three specialized lasers from Germany to China, which could constitute additional charges under Germany’s foreign trade regulations.

This clandestine operation was uncovered through investigations by the Federal Criminal Police Office, resulting in the arrests of the accused in April of the previous year in the cities of Düsseldorf and Bad Homburg, alongside comprehensive searches of their homes and business sites.

While Thomas R.

remains in detention, Herwig and Ina F.

were released from custody in October after their arrest warrants were suspended.

This case is being recognized as a severe breach of Germany's critical military technological security, with implications resonating beyond national borders.

German Interior Minister Nancy Faeser emphasized the importance of the sector involved and highlighted the role of the Federal Office for the Protection of the Constitution in the investigation process.

The international ramifications of this case extend well beyond Germany, spotlighting the burgeoning global debate surrounding technology transfer and espionage amid escalating international technological competition.

As the court in Düsseldorf deliberates on proceeding with a trial, the outcome could unveil vital insights into the modus operandi of espionage networks across Europe and their impact on global security and technology exchange.
