Wagenknecht has asserted that there are indications of several thousand BSW votes potentially being misallocated and has stressed the necessity of a nationwide recount to ensure voter integrity.

She highlighted the responsibility to respect the electorate and has called for a thorough examination and rectification of any errors before the official final results are declared.

The entrance of the BSW into the Bundestag is viewed as critically significant, having the potential to influence the current balance of power, which is primarily held by a coalition of the Union and Social Democratic Party (SPD).

Wagenknecht posited that a party should only be deemed to have failed to meet the five-percent threshold if it can be conclusively demonstrated that it did not garner adequate support.

Indications from a specific recount involving twelve polling stations in Berlin have suggested the presence of additional BSW votes, reinforcing the party's claims for a recount and indicating a possible pathway to parliamentary representation if extrapolated on a national scale.

The Federal Election Committee is scheduled to confirm the official final results on the forthcoming Friday.

Upon that confirmation, political parties will have the opportunity to object or pursue further legal measures.

Legal expert Christoph Degenhart, representing the BSW, has emphasized the critical need for a thorough review of the election process due to the narrowness of the result, cautioning that neglecting such a review by the time of the final results could lead to legal complications and jeopardize democratic legitimacy.

Uwe Lipinski, another legal representative for the BSW, has echoed these concerns, highlighting that without rapid legal protection, rectifying the election outcome may only occur during the current legislative term or through a later judicial review at the Federal Constitutional Court.
